1. Acceptance of Terms

By accessing and using AIKIZI ("the Service"), operated by Kalai Labs Pvt Ltd (India), you ("User") accept and agree to be bound by these Terms of Service. If you do not agree to these terms, you must not use the Service.

AIKIZI is an AI-powered platform that analyzes images, videos, and audio content to provide creative insights, style analysis, and generation prompts. By using our Service, you acknowledge that AI-generated content may contain inaccuracies or errors.

2. Eligibility and Age Requirements

Minimum Age: You must be at least 13 years old to use AIKIZI. By creating an account, you confirm that you meet this age requirement.

Parental Consent: If you are between 13 and 17 years of age, you may only use AIKIZI with the consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

Account Responsibility: If you create an account for a minor, you are responsible for their use of the Service and agree that they will comply with these Terms.

3. AI-Generated Content Disclaimer

Important Notice About AI Content

AIKIZI uses artificial intelligence to analyze and generate content. AI outputs may contain errors, inaccuracies, biases, or inappropriate content. Always review AI-generated content before use.

  • No Guarantees: We do not guarantee the accuracy, completeness, or reliability of any AI-generated analysis, prompts, or creative suggestions.
  • Human Review Required: Users should review and verify all AI outputs before using them for any purpose, especially commercial applications.
  • Creative Interpretation: AI analysis represents one possible interpretation. Different AI systems or human experts may provide different analyses.
  • Not Professional Advice: AI-generated content does not constitute professional, legal, medical, or artistic advice.

AI Content Labeling: In compliance with applicable regulations, AI-generated and AI-analyzed content on AIKIZI is identified with visible disclosures on the platform. Images in the Explore gallery are predominantly AI-generated using third-party tools (such as MidJourney, Google Imagen, and similar services). If you share AI-generated content from AIKIZI externally, you must maintain appropriate labeling to indicate the content was generated or assisted by AI.

3.1 AI-Assisted Platform Development

This platform's codebase was developed using AI-assisted coding tools under human direction. The software architecture, security implementation, feature design, and user experience were conceived, directed, and reviewed by the platform's founder. The AI served as a development tool to generate code based on human specifications and intent.

While the platform employs industry-standard security practices — including row-level security, JWT authentication, rate limiting, encrypted secrets management, and payment processing through certified third-party providers (Dodo Payments, Razorpay, Apple StoreKit, and RevenueCat for iOS in-app purchases) — users acknowledge that all software, regardless of development method, may contain bugs or imperfections.

The platform is provided "as is" under the warranty disclaimers in Section 10 of these Terms.

4. Token Economy and Credits

AIKIZI operates a credit-based system. Credits are virtual units used to access premium features.

  • Credits have no cash value and cannot be exchanged or transferred
  • Subscription credits are included with your monthly or annual plan and expire at the end of each billing cycle. Unused subscription credits do not roll over
  • Purchased credit packs (bought separately) expire 12 months from the date of purchase
  • Credit prices and costs for features may change at any time with reasonable notice
  • We reserve the right to modify or discontinue the credit system with reasonable notice
  • Refunds: Credits are not refundable on user request. However, if a feature fails due to a system error (e.g., a failed decode or generation), credits are automatically refunded to your balance
  • Subscription Cancellation: If you cancel a subscription, you retain access to your plan's features until the end of your current billing cycle. No partial refunds are issued for unused time within a billing period

5. User Content and Licensing

Your Ownership: You retain all ownership rights to content you upload to AIKIZI.

Ownership Representation:

By uploading any content to AIKIZI, you represent and warrant that:

  • (a) You are the original creator and sole owner of all rights to the content, OR
  • (b) You have obtained all necessary licenses, permissions, rights, and consents from the rightful owner(s) to upload the content and grant the licenses described in this Section 5;
  • (c) Your content does not infringe, misappropriate, or violate any third-party intellectual property rights, privacy rights, publicity rights, or any other proprietary rights;
  • (d) You have the legal authority to grant AIKIZI the rights described herein.

You acknowledge that AIKIZI relies on these representations and that uploading content without proper rights may result in account termination and legal liability.

License Grant: By uploading content, you grant AIKIZI a non-exclusive, worldwide, royalty-free license to:

  • Process and analyze your content using AI systems
  • Store your content securely on third-party cloud infrastructure
  • Display analysis results to you
  • Use anonymized, aggregated usage patterns (such as popular categories and feature usage) to improve our services. We do not use your uploaded images, videos, or audio content to train AI models.

Public Sharing: If you choose to publish or share your content publicly on AIKIZI, you grant other users the right to view and interact with that content according to the sharing settings you select.

License Termination: The license granted to AIKIZI under this section terminates when you delete your content or your account is terminated, except for anonymized, aggregated data that does not identify you or your content.

6. AI Content Generation

AIKIZI offers AI image, video, and audio generation features using third-party AI models. By using these features:

  • You agree to the terms of the underlying AI providers for these features, listed in Section 4 of our Privacy Policy (for example Google Gemini, ElevenLabs and BytePlus)
  • You are responsible for ensuring generated content does not infringe third-party rights
  • You must not generate content depicting real individuals without their consent
  • You must not generate content that is illegal, harmful, or violates platform policies
  • Generated content may be subject to the licensing terms of the AI model provider
  • Your rights to use content you generate are described in Section 9(b). Subject to the conditions in these Terms and the applicable AI provider's terms, you may use content you generate through AIKIZI for personal and commercial purposes.
  • Audio made with ElevenLabs models is also subject to ElevenLabs' terms. ElevenLabs is a third-party beneficiary of these Terms as they apply to that audio and may enforce them directly.

7. Prohibited Uses

You agree not to use AIKIZI to:

  • Upload or generate illegal, harmful, abusive, or exploitative content
  • Upload content depicting minors in inappropriate contexts
  • Infringe on intellectual property rights of others
  • Generate deepfakes or misleading content intended to deceive
  • Attempt to abuse, exploit, or circumvent the credit system
  • Reverse engineer, copy, or extract our AI models or systems
  • Use automated bots or scripts to access the Service without permission
  • Violate any applicable laws or regulations

8. Pro Accounts and Publishing

Pro accounts and publishing to your profile are subject to additional terms:

  • You must only publish appropriately licensed content
  • We may review, moderate, or remove any published content
  • Publishing may be turned off for an account at any time for policy violations
  • Pro features are subject to fair use limits to prevent abuse

9. Intellectual Property

AIKIZI Property: The Service, including its design, code, AI models, and branding, is owned by AIKIZI and protected by intellectual property laws. You may not copy, modify, or create derivative works.

Commercial Use of Platform Outputs:

(a) AI Analysis Outputs (Decode Results):

  • Basic Tier (as priced on the Pricing page): Analysis outputs may be used for personal and commercial purposes.
  • Pro Tier (as priced on the Pricing page): Analysis outputs may be used for personal and commercial purposes with priority support.

(b) Content You Generate Using AIKIZI:

  • When you use AIKIZI's generation features (image, video, or audio creation), your creative inputs — including prompts, parameter selections, reference images, and iterative refinements — contribute to the final output.
  • AIKIZI does not claim ownership of content you generate. Paid tier users, and every signed-in user for audio made with the free audio minutes, may freely use content they generate through AIKIZI for personal and commercial purposes, including in client work, products, merchandise, publications, and digital media. Music made with ElevenLabs may not be used in film, TV, radio or games beyond indie size, and music prompts may not name artists, songs or labels.
  • Your use of generated content is subject to the terms of the underlying AI provider whose model was used. These providers are listed in Section 4 of our Privacy Policy (for example Google Gemini, ElevenLabs and BytePlus). AIKIZI does not control and is not responsible for provider-imposed restrictions.
  • AI-generated content may not be copyrightable under current law in all jurisdictions. AIKIZI makes no warranty regarding copyright ownership, exclusivity, or registrability of generated content. Multiple users using similar prompts or inputs may receive similar outputs.
  • You may not claim that AI-generated content is solely human-created work where disclosure is required by applicable law.

(c) Downloaded Explore Content:

A readable summary is available in the AIKIZI Image License. These Terms control if there is any conflict.

  • Images available for download in the Explore gallery are AI-generated using third-party tools (including MidJourney, Google Imagen, and similar services) and are provided under a non-exclusive use license for paid subscribers.
  • You may use downloaded images in your creative projects, including videos, presentations, designs, prints, and professional work.
  • Downloaded images are non-exclusive. Other users may download the same images. AIKIZI and the underlying AI providers retain rights to the same content per their respective terms.
  • AI-generated images may not be copyrightable under current law. AIKIZI makes no warranty regarding copyright ownership, exclusivity, or non-infringement of downloaded content.
  • Prohibited: reselling downloaded images on stock image or wallpaper platforms; claiming AI-generated images as solely human-created work; using for illegal purposes.
  • Attribution to AIKIZI is appreciated but not required.

(d) Your Uploaded Content:

  • You retain full ownership and all rights to your original uploaded content.
  • You may use your uploaded content for any purpose without restriction from AIKIZI.

(e) Synthetically Generated Content (SGI) Disclosure:

  • In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Amendment Rules, 2026, AIKIZI identifies synthetically generated and AI-generated content with visible disclosures on the platform.
  • Content in the Explore gallery is predominantly synthetically generated using AI image generation tools.
  • Users who generate content using AIKIZI's creation features are responsible for disclosing the AI-generated nature of that content when sharing externally.
  • AIKIZI reserves the right to add metadata, labels, or identifiers to AI-generated content to comply with applicable regulations.

AIKIZI retains rights to the underlying analytical methods and presentation formats used to generate outputs.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) AI-generated content will be accurate or reliable; (c) defects will be corrected; or (d) the Service is free of viruses or harmful components.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIKIZI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid to AIKIZI in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless AIKIZI and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: (a) your use of the Service; (b) your content; (c) your violation of these Terms; or (d) your violation of any third-party rights.

13. Modifications to Terms

We may update these Terms at any time. For material changes — particularly those affecting your privacy rights, data handling, or content licensing — we publish a new version of these Terms. On the web, we record which version you accepted and ask you to accept the updated Terms again before you continue using the Service.

For minor or clarifying changes that do not materially affect your rights, your continued use of the Service after notification constitutes acceptance. If you disagree with updated Terms, you must stop using the Service.

14. Termination

We may suspend or terminate your account at any time for violations of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Unused credits are forfeited upon account termination.

15. Copyright Infringement (DMCA)

If you believe content on AIKIZI infringes your copyright, you may submit a takedown notice to:

Your notice must include:

  • Identification of the copyrighted work
  • Identification of the allegedly infringing material with sufficient detail to locate it
  • Your contact information
  • A statement of good faith belief that the use is not authorized
  • A statement under penalty of perjury that the information is accurate
  • Your physical or electronic signature

We will respond to valid notices in accordance with applicable copyright laws.

Counter-Notification

If you believe your content was removed in error, you may submit a counter-notification to hello@aikizi.com with the subject "DMCA Counter-Notification," including:

  • Identification of the material that was removed and its former location
  • A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  • Your name, address, and telephone number
  • A statement consenting to jurisdiction of the courts in Hyderabad, India
  • Your physical or electronic signature

Repeat Infringer Policy

AIKIZI maintains a policy of terminating the accounts of users who are determined to be repeat infringers of copyright or other intellectual property rights, in appropriate circumstances and at our sole discretion.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, India.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms constitute the entire agreement between you and AIKIZI regarding the use of the Service.

19. Waiver

Failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

20. Grievance Officer

In accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the following person is designated as the Grievance Officer:

Complaints will be acknowledged within 24 hours and resolved within 15 days of receipt.
